Terms and Conditions for ELMA Education Pty Ltd
These terms and conditions (“Agreement”) govern the purchase and use of ELMA Education Pty Ltd’s (“ELMA”, “we”, “us”, or “our”) online emotional literacy programs (“Programs”) by the customer (“you” or “your”).
1. Acceptance of Terms
By purchasing and using our Programs, you agree to and accept these terms and conditions. If you do not agree with any of these terms, you should not purchase or use our Programs.
2. Program License
Subject to your compliance with these terms and conditions and your payment of any applicable fees, ELMA grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use our Programs.
3. Fees and Payment
3.1 Licensing and Subscription Options
The at home family program is a monthly subscription model.
The Early Childhood Program is an annual subscription.
The Primary School Program is an annual subscription.
The Teen Program is a once off fee.
The Private Instructor Training is an ongoing subscription.
The annual licence fee grants you access to our Programs for one calendar year from the date of purchase. The licence will automatically renew at the end of each year unless cancelled.
The once-off fee gives you perpetual access to the specific version of our Programs available at the time of purchase.
3.2 Payment
Payment is due at the time of purchase. We accept major credit cards, debit cards, and other payment methods as indicated at checkout.
3.3 Refunds
All purchases are final and non-refundable, except as required by law or as otherwise stated in this agreement.
4. Intellectual Property
All intellectual property rights in our Programs are owned by ELMA or our licensors. Your purchase of a license does not grant you any ownership rights in our Programs.
5. Restrictions
You may not: Resell, redistribute, or sublicense our Programs use our Programs for any illegal or unauthorized purpose
remove, obscure, or alter any copyright notices or other proprietary rights notices affixed to or contained within our Programs
6. Termination
We may terminate your access to our Programs if you violate these terms and conditions. Upon termination, you must immediately cease all use of our Programs.
7. Limitation of Liability
To the maximum extent permitted by law, ELMA will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our Programs.
8. Changes to Terms
We may change these terms and conditions at any time without notice. Your continued use of our Programs after any change constitutes your acceptance of the new terms and conditions.
9. Governing Law
This agreement is governed by the laws of the state of Western Australia, without regard to its conflict of laws principles.
